FABGO LOGISTICS - SHIPPER TERMS & CONDITIONS
By registering as a Shipper on the FabGo Logistics platform, you acknowledge and agree to the following terms:
1. CARGO RESPONSIBILITY
You are solely responsible for accurately describing your cargo, including type, weight, dimensions, and any special handling requirements. Misrepresentation of cargo details may result in additional charges, service delays, or outright service denial. You must ensure all cargo information is complete and truthful.
2. PAYMENT TERMS & ESCROW
All payments for shipments are held in a secure escrow account until delivery is confirmed. Once the truck owner uploads the Proof of Delivery (POD), you have 48 hours to review and approve it. Failure to review the POD within this 48-hour timeframe will result in automatic release of funds to the truck owner. This policy ensures fair and timely payments.
3. INSURANCE OPTIONS
FabGo Logistics offers optional cargo insurance for your shipments. If you choose to decline insurance coverage, FabGo Logistics and its affiliates are NOT liable for any damage, loss, theft, or destruction of cargo during transit. It is your responsibility to assess risk and make an informed decision about insurance.
4. PLATFORM COMMISSION & FEES
An 8% platform commission is applied to all shipment transactions. Additionally, 7.5% Value Added Tax (VAT) is charged as required by Nigerian law. These fees cover the costs of matching services, real-time GPS tracking, secure escrow payment processing, dispute mediation, and 24/7 customer support.
5. DISPUTE RESOLUTION
Any disputes regarding deliveries, damages, or service quality must be raised within 48 hours of the shipment's delivery date. FabGo Logistics will act as a mediator to resolve disputes fairly. If mediation fails, disputes will be resolved through arbitration under the laws of the Federal Republic of Nigeria.
6. PLATFORM USAGE
You agree to use the platform in good faith and comply with all applicable Nigerian laws and regulations. Any fraudulent activity, abuse of the platform, or violation of these terms may result in immediate account suspension or termination without refund.
7. LIMITATION OF LIABILITY
FabGo Logistics acts as an intermediary platform connecting shippers and truck owners. We are not responsible for the physical transportation of goods. Our liability is limited to the platform services provided. In no event shall FabGo Logistics be liable for indirect, incidental, or consequential damages arising from your use of the platform.
8. DATA PROTECTION & PRIVACY
Your personal and business data will be handled in accordance with our Privacy Policy and the Nigeria Data Protection Regulation (NDPR). By using the platform, you consent to the collection, storage, and processing of your data as outlined in our Privacy Policy.
9. ACCEPTANCE OF TERMS
By clicking "Accept" below, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. This agreement is legally binding and will govern your use of the FabGo Logistics platform.
